AerTrak Operator Mobile App Privacy Policy

The purpose of the Operator Mobile App that you are downloading (the “App”) is to allow you to use certain features of the Aeris AerTrak asset tracking and management service (the “Service”). You will need to have login credentials in order to access the Service from the App. These credentials may be issued by your employer or by the company that is providing the Service (the “Service Provider”).

The App will collect certain information from you when you use it as described in more detail below (“Your App Data”). This Privacy Policy describes what types of information are collected, the purposes for collecting the information, and who may use it. By using the App and interacting with the Service, you consent to this use of Your App Data.

Data Controllers

Your employer (or, in some cases, you) will be entering into a contract for the Services with the Service Provider, which may be located in any country. Your employer or the Service Provider direct what information is being collected for the Services (including any information about how you interact with the Services using the App), and will be the Data Controller for the Services. Aeris Communications, Inc., a company in the United States (“Aeris”), hosts the Services for the Service Provider and processes data relating to the Services as a Data Processor. Aeris also determines what information will be collected from your use of the App and will be considered the Data Controller responsible for Your App Data.

Services

This Privacy Policy applies to your use of the App in connection with the Services unless any of the Services state that they are offered under a different privacy policy.

Consent

If you use the App, you consent to the collection, use and sharing of Your App Data as described in this Privacy Policy. If you use the App after an update to this Privacy Policy, you consent to the changed policy.

Change

We may modify this Privacy Policy, and if we make material changes to it, we will provide notice through a notice at the Google Play Store, or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you should notify your employer or the Service Provider of your objection. If you continue to use the App after we publish or send a notice about our changes to this Privacy Policy, we may take that to mean that you are consenting to the updated Privacy Policy.

Information We Collect

  1. We collect information about the app store from which you downloaded the App, the App version you downloaded, and the date and time of the download.
  2. The App may give you the ability to have an SMS message sent to a contact that you designate in certain events. We would collect the mobile number to which you want the message sent and would keep data about sending any such messages.
  3. When you open the App, visit any pages, or interact with the App to view Service data or to take actions, we log your visits and the actions that you take. We do not view or copy your login credentials you use to access the Services. We may assign a unique identifier to the device you are using so that we can later understand which actions were taken by which device, but this identifier is generated randomly and cannot be used to identify you personally. Please note that the Service will be able to associate your actions using the App with your login.
  4. We currently do not intend to collect location data from you. When we log the time at which you took any actions, we use the GMT time value rather than attempt to determine your location by looking at your local time.

We are continuously working to improve our Services, including the App. We may choose to start collecting new types of data and create new ways to use data. For example, we often introduce new features, which may require the collection of new information. If we collect materially different personal data through the App or materially change how we use Your App Data, we will notify the Service Provider, who will attempt to notify you. We may also modify this Privacy Policy.

How We Use Your App Data

  1. We use Your App Data to provide, support, and develop our Services, including our mobile Apps. We will not serve you with any ads on the App. both on and off of our Services. For example, we may use Your App Data to help you or other users of the App, to fix problems, and to investigate, respond to and resolve complaints and service issues (e.g., bugs).
  2. We use Your App Data aggregated with other similar data to generate insights, such as to generate statistics about our users, the types of actions they take, how quickly they are able to complete actions, and the like.
  3. We may use Your App Data for security, fraud prevention and investigations, such as in cases of possible fraud or other violations of any agreement for Services, or any attempts to harm any person or company.

How We Share Information

  1. Any information you include in any comment on an app store will be visible to others.
  2. We may share Your App Data with your employer (number of times used, actions taken) or with any Service Provider for their use in using or operating the Services.
  3. We may use others to help us with our services, such as maintenance, analysis, fraud detection, and development). They will have access to Your App Data as reasonably necessary to perform these tasks on our behalf and are obligated to not to disclose or use it for other purposes.
  4. We may need to share Your App Data when we believe it’s required by law or to protect your and our rights and security. If Your App Data includes any information that would reasonably allow a third party who does not have access to your employer’s or the Service Provider’s systems to identify you, we will, unless prohibited by law or court order or when the request is an emergency, notify the Service Provider about legal demands for your personal data so that they may notify you.
  5. We may share Your App Data when our business is sold to others, but it must continue to be used in accordance with this Privacy Policy.

Data Retention

We only intend to keep Your App Data until we have been notified that your login credential have been terminated or for so long as is required to help the Service Provider provide the Services. Because we do not believe that Your App Data will contain personal data, we do not maintain a process for you to access or delete any of Your App Data.

Security

We implement security safeguards designed to protect our App and Your App Data, and regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send through the App. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Cross-Border Data Transfers

We process data both inside and outside of the United States. You consent to the transfer of Your App Data to any location where we provide services in connection with the Services.

Contact Information

Because we do not collect your name or your contact information when you download the App, we do not know who you are. If you have any complaints about the App or this Policy, please work with your employer, who will involve the Service Provider to get a resolution to your issue.
